Baldwin has denied pulling the trigger and told investigators the assistant director told him it was a “cold weapon,” implying it wasn’t filled with live shots.

The initial investigation into Hutchins’ death was led by Santa Fe County Sheriff Adan Mendoza, who spoke of “a certain carelessness” on the film’s set.

According to prosecutors, Baldwin and Gutierrez-Reed face “alternative” charges. That means a jury would not only decide if they’re guilty, but also under what term of manslaughter by negligence they’re guilty.

Assistant director David Halls has also agreed to a plea deal alleging negligent use of a deadly weapon. The plea agreement provides for a suspended sentence and six months’ probation.

The second charge is manslaughter while carrying out a legal act. This charge requires proof of more than simple negligence in a death.

This second offense is also punishable by up to 18 months in prison and a $5,000 fine. This crime carries a firearm amplification, implying that there is a mandatory additional penalty because a firearm was involved. The improvement includes a mandatory five-year prison sentence.
